"US Consulate General, Hyderabad, Cornelis M Keur addressing media persons at the 'meet the press' programme organised by Press Club Hyderabad said that due to economic slowdown the world over, the US government has taken a decision to tie up its unemployment problem which is nine per cent. But, there was no significant change in visa policy. "We continue to issue H1B visas with little more scrutiny," Keur said.
He said that, at the same time, the US government has framed a policy for the companies to give preference to native Americans in employment.
Obama administration has taken up a practical approach in establishing relations with the countries while there were efforts in strengthening relations with India because of the "Brain Borrowing", he said.
Keur said there are 3 million Indians in the US who are contributing to its prosperity specially mentioning about the Andhraites who marked their presence in various fields in the US including IT.
Keur said the Hyderabad Consulate, the fourth in the country was established due to the growing trade and development in the state in the IT, biotechnology and pharma sectors."

... But the consulting firm advised against it as according to them if she re-enters in H4 (even before Oct 1) while her H1 approval is pending, her H1 application will be cancelled and she has to restart the process all over again. Something to do with the last status on re-entry.
I think this issue used to be there. Why do you think otherwise? COS is not computerized to happen on Oct 1. It is manual process, while approving H1B, it is done. When someone enters after that on H4, then that COS is overwritten.
What lawyer is telling in this regard?

I have applied for my H1 extension in July 2010 and still waiting for the approval. My in-laws are visiting the US in dec and i am sponsoring their visit. Should my H1B be approved before they appear for the Visa interview or should the H1 receipt notice be enough? Please let me know.

There is no such rule that you should have an approved H1B in hand. However you never know the kind of immigration officer your in-laws/parents see at the embassy. If it is not too urgent wait till your H1B is approved. If it is urgent just write a letter stating the facts accompanied by a copy of your old H1b, new H1B receipt notice and a letter of continued employment from your employer. Yes include other documents like paystubs, past tax returns and etc.

I wanted to ask a question about my status based on the situation described below:
1. I entered the United States on F1 Visa in 2003.
2. Applied for and got H1B approved, with the bottom right part attached. The visa was valid till November 2008.

They are not liable to pay from the the day application was sent.
Instead, they are liable from the start date they requested on the petition OR the day you are physically in US whichever is later.
In most cases employers request immediate start dates so that the employee can start working as soon as the petition is sent (portability).

My PD is Feb 20, 2006. I fall into EB-3 ROW and it seems like my PD will be current in May 2008. I filed my I-485 in Aug 2007 and have had my EAD and AP approved. I got married in Sept 2007 and my spouse came here on H-4 after our marriage and we both have valid visas respectively H1 and H4. She can't file I-485 to adjust status until May due to PD not being current. We would like to handle the task of filing I-485/EAD/AP for her ourselves without paying our attorney. I do have all documents my attorney filed for myself so I plan to mimic them when we file my spouse's papers.
What I do not know is, if there's anything we need to do for her to represent herself. Do i need to let my attorney know that we are filing I-485 on our own? Does my attorney need to do anything?
I am thinking that her application should be easier than mine as she is simply a dependent.
Do I need to sign anything or fill out any form as the primary applicant or the approach is simple.... as long as she can prove that she is my spouse, (I have a I-485 pending) and PD is current she can do AOS?
Do all forms for I-485, EAD and AP need to be mailed together? Is information about her background/work/school diploma needed?

So are these different from the finger prints that we take for EAD? For people who got their priority date current, do they ask for a separate finger prints again? Does anyone can shed some light on this?
Yes the finger printing for EAD is type 2 and for I485 it is type 3. They are different.
Photos are different (this is an example)

that's excellent news, but may not be very helpful for those whose priority dates are retrogressed, whether the I-140 is approved in 1 month, or 12 months.
Premium processing (i.e. PERM) helps labor applicants more because of the difference in processing times between regular and PERM processing.
For I-140 the average processing time is about 3 months only (source: http://www..com/usa-immigration-trackers/i140-graph/), so what's the big advantage of premium processing for I-140? Are they going to approve I-140 in one day with premium processing?

I work for a Fortune 10 company ( I am FTE there) and have been working with them since 2001. Got my 4th 3 year H1b Extension in 2009.
I had the visit from USCIS officer few months back, she said that is it Random. She asked routine questions. In our company we have two titles a corporate title and a working title (one for industry and one for job) she was very understanding about that difference. She asked me for a salary slip, address for my HR and some routine questions for my job.
I did talk to my lawyer after that and she said that she has started hearing about that for our company and it is ok. It is nearly 3 months since then and I have not heard anything so I assume everything is ok.
Don't worry I was very unsetled to see the USCIS and it did take me few days to get over it, but everything should be ok.

Hi,
I am in a unique situation, any advise/help would be appreciated.
My H1 Visa and I-94 are expiring on Jan 20, 2009. It can be extended till Apr 2011 as I have been in US only for 3 Yrs and 8 Months. My current employer is not extending my Visa, so I am going to get it extended through another company, say COMPANY ABC (a Staffing company basically).
However, I don't want to be with Company ABC because I am soon going to get a job with a direct client, CLIENT XYZ, but that won't happen until Jan 25th or so.
So my question is, if I apply for extension through COMPANY ABC for now, just so that I don't go 'out of status' on Jan 20th, will CLIENT XYZ be able to apply for my extension on Jan 25th, while my application with Company ABC is still pending? Or they (CLIENT XYZ) will have to wait until my first application (With COMPANY ABC) is processed?
Basically, just want to know if a Company ABC has filed for H1 Transfer and I-94 extension before the expiry date, can another Company XYZ file for an extension/transfer after the expiry while the application from company ABC is still being processed?
Any help is appreciated. I have posted this query on couple of other posts but no one seems to know the answer! no one replied yet :(

In my case I applied for my MIL visa extension on March 15th. We received the approval last week. Her I-94 expired on May 15th, we chose to wait till we heard the decision.
I only requested for 4 months. Also, this is the second extension I applied for my MIL and this is her 4th visit to US. My take, you should be good as long as you state a valid reason and show good financial support..
