But my lawyer chose this. and I already signed the form. Does it really matter? As he stated " Spose has an approved I-140"
If you are a dependent, you should probably choose (b). I chose (b) for my dependent wife, which is what my attorney recommended. Don't know about (h), but why complicate matters?

Ever heard of the adage - 'Too many cooks spoiled the broth'. If every one here starts creating their own 'Action Items' here, confusion will abound - which one is Official (IV sponsored) and which is is proposed by an individual member!
If you're interested in creating 'Action Items' of your own - join the State Chapters, share your ideas with other members and chapter leaders. If there's enough support for it in the group, chapter leaders will take it up with the Core. Once sanctioned by the core, it will become a real 'Action Item' on IV.
Lets follow this process, for the benefit of all and to avoid confusions.

I'm off to London for my H1B stamping. I was working for an Investment Bank that folded and I took up a job with a bank that has not taken TARP funds (not a US bank)
My I-129 was approved, however, it was approved before the new I-129 that asks whether the company accessed covered funds.
I just wanted to know whether I need to ask counsel in my firm to update the I-129 or should I just go ahead with the stamping?
Any other important documents I should take along? I was thinking of
a) letter from employer stating salary, start-date, position etc
b) letter from company stating that they did not receive TARP
anyone else on the same boat?
not in the same boat but in my opinion if you don't have to travel then lay local for a while given the restrictions being put in place with h-1 visas for financial institutions as a whole.

of the picture, I would suggest taking the picture in the positive, to basically view IV as our voice in DC. :)

In my job search (banking and finance jobs) there is this one question i come across on each and every job application-
"Do you now or will you in the future require sponsorship to legally work in the united states?"
and options to tick on the form are 'yes' or 'no' with no space for explanation.
So i mark 'yes' and i guess thats where my job applications get stuck.
Should I answer yes or no, since i am on L2 (visa valid for next 2 years) and currently have 2 years Employment Authorisation (EAD) where i can work for any employer in the United States ?
I understand that companies ask this question because some of them are not allowed/ do not have a policy to sponsor visas.
I want to know whether i am legally required to say 'yes' beacuse i am on L2 ( since after 2 years, my visa renewal depends on whether or not my spouse's L1 is renewed)
OR
Do I still have a choice to say 'no' since my visa renewal gets done if my husband's gets done or i manage it on my own through a consultant... and the company i will join in both cases does not have to sponsor or pay for my visa either now or in the future.
I do not want to misrepresent any information and get thrown out of the organisation after i join, nor do I want to lose out on opportunities because of answering this question wrongly.
(There is a separate question that asks if i am legally allowed to work in the US and i answer 'yes' to that since i have an EAD)
Let me know please, it'll help a lot.

Yes, the numbers are fixed. Therefore, those who filed in July and August, which were not given number from FY2007 will get from FY2008. And that would be too many for countries like India and China.

If you have a beneficiary number on I-140, put that.
If you ever had an OPT EAD card, put that.
If you have both, put I-140 number.
Otherwise leave blank.

I am on l2 since my husband is on L1. I work full time for a US employer with an EAD. Now, what would happen to my status if my husband quits his job? you have EAD, that EAD was entirely based on your L2 status. If L2 status is gone so EAD is invalid too....

this link says that minors over 14 need to sign their own forms.
please verify this with your lawyer or official I-485 instructions (you should be able to find instructions on the uscis website) before you use this as gospel!

I am applying for my AP and EAD renewal, please help me with few questions:
For EAD:
14) Manner of last entry: H4? (I was on H4 when I last entered)
15) Current Immigration Status: AOS? (My husband received his GC)
16) Eligibility: ???
17) Eligibility: None?
For AP:
1.3) Class of Admission: H4?
3.2) Expected length of time: ???
Last time, my husband's company attorney had filed our papers. Since, my husband received his GC, we have to renew ourselves. Should I send a form to cancel G28? Thanks in advance to all for their time and advise.

Every week 100 to 200 new H1b applications were submited. If it goes in this rate H1b quota will last whole year. It is a good development,
As of May 29, 2009, approximately 45,800 H-1B cap-subject (http://www.h1b.biz/lawyer-attorney-1137085.html)petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.
Since it is probable that there will still be H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) numbers available after June 30, U.S. employers should submit H-1B petitions for potential workers as soon as possible.

My passport was expiring so I applied for the new passport to indian embassy San fransisco. I got this new passport from indian embassy san fransisco. Now my company has applied for my H1B extension with the details of this new passport. We got a receipt number for the H1B extension but it looks like that it will take 2 more months to get the actual extension in hand.
Recently I found that my new passport has my mother's name speling mistake (one letter wrong). I am planning to call indian embassy to make this correct. As they made this mistake while creating this new passport ( my old passport and the application had the correct mother name )
I have following questions:
1. Does embassy cancels the existing passport and issues new passport in such case ? OR
It makes correction in the existing passport.
What does it do in such cases?
2. If embassy cancels the current passport and issues the new passport then in that case I should go for this change after I got my H1B extension approval (because my H1B extension has the details of current passport). is my understanding correct?
3. Say I reqest for this change after getting the approval of H1 extension and I get a new passport from the indian embassy then in that case do I need to inform about that new passport to the USCIS.
What should be the best sequesnce OR way to correct all this.
