i have a valid H1 visa on my passport till 14th dec 2007. yesterday i got the new I-797 with I-94(I-94 dates are mentioned as 15th Dec 2007 to 14th Dec 2010). Since my visa is expiring on 14th Dec 2007, I want to go for stamping before Dec 2007 to Nogales (i have some travel plans in Jan 2008). When can i go for(how soon) stamping. I am planning to go this sept. CAn I ?????

I have a question about multiple 485 filings.
My PD was Eb3 May 2002 and I filed my 485 last week. My wife was added to the application as well.
Now my wife's PD is current and her date is EB3 Jan 2006. Can we file her 485again and add me again as her dependent.
Attorney says no but I am not sure if I can believe them. Besides there is a risk of not filing again for her seperately as in the future the dates may retrogress. I would prefer that both of us have independent applications in as well so we can both fall back on each others application if the need arises.
Is any one else in my shoes and knows the answer

Note that EAD is not a valid document for re-entry.
If you have a valid AP - you can re-enter
or
If you have a valid H1/H4 AND un-expired visa stamping - you can re-enter
I had my H1 extension pending and I was able to re-enter using AP (on July 18, 2008 at San Francisco)
She has the F1 stamped on the passport which is valid until Dec 2009 I think. She is finishing much before that. Does it mean she will not be able to reenter on either F1 visa or the EAD?

I heard that it is pretty easy there. 2 years back One of my friend got 10 year multiple entry visa from singapore. He has told me that there was no queue in american consulate in Singapore.

TSC is still receipting June filers so there is no question July yet. Only after they clear June will they even touch July. Many folks have reported that USCIS customer service is responding to them that it may take two more weeks for TSC to clear June. So, just trying to get a sense of how many people from June are still waiting for receipts.

How can you change jobs if you have not filed for I485 and it has not been pending for >6months?
If you change jobs you will have to start green card process again.
If you stay with your current company, and if PD becomes current in summer, they can file for 1485 and then once your i485 is pending for >6 months you can try to change jobs using AC21.
Gurus step in and correct me if I am wrong.

Can we ask for a new legislation that will allow for complete portabilty after i-140 approval? If this is achieved I don't think retrogression/insufficient Visa#'s would be a big deal.

I got my petition approved, but my change of status was denied.
The reason was stated as :

The US Department of State has released the new Visa Bulletin (http://travel.state.gov/visa/frvi/bulletin/bulletin_4575.html) for October 2009. In family-based categories, there is very slight movement forward, but just by a few weeks or months in most categories. However, Family 1st Preference for Mexico moves forward by 17 months
Employment-based categories remain "Current" for all 1st preference applicants, and for 2nd preference from Mexico, China, and countries other than India and China.
The biggest change is that the bulletin once again lists priority dates for 3rd Preference and Other Workers. These categories have been "Unavailable" since the May 2009 bulletin. Unfortunately, the priority dates listed on the October bulletin are all at least a few weeks behind the dates listed the last time, in the April bulletin. during our meeting with the lobbyists in Washington D.C. one thing stood clear. We have to get our employers in the big picture and we need to meet the lawmakers. For this we are going to start this effort �Meet the lawmakers�. The material and corresponding will eventually come from the Lobbying firm. But in the mean time we need to build the team. Immigrationvoice Board of directors has given me the responsibility to build this specific team. I did my masters in US and have got my H1 B status which expires next year. Had a few question. Just to add to my situation i have not got my H1 stamping done on my passport.
Q1. Can i apply for an extesion without a visa stamp.

Former president's Bill Clinton and George W. Bush were both in Canada last week. Neither one of them knew that you now require a passport to re-enter the U.S. as of June 1st, from Canada. That should give you an idea of just how tuned in these people are.

I have a question regarding AP. I have AP's based on my pending 485. Recently i traveled to India (on a family emergency) using my AP which was issued in 20th Nov 2008 valid till 19th Nov 2009. I had no issues & got thru JFK using the same.
I was out of US from Sep 23rd thru Oct 24th 2009.
Before leaving US I applied for my AP in early Sep, which got approved by Sep 29 and was in my mail box by the time I arrived. The New pay roll has validity from 20 Nov 2009 until 19 Nov 2010.
My question is, I may need to travel to India again for couple of months that is some some time near 5 Nov 2009 & will be back by Jan 2010.
Do you guys foresee any other issues? , I herd that the AP is NOT valid if you are out of the country.

Just curious to know whether anybody received the physical card with out a CPO email or status. Did anybody with just "Welcome" email and status receive cards yet?
Just checking whether NO CPO status/ email = no card.
I received the "Welcome" email, status and the physical letter on Tuesday but no card yet. Any body in the same boat? (I understand that it takes about 1-3 weeks but many have received cards with in a week)
The reason I am asking is my I9 expires month end and HR is on my back for the updated doc. They would rather see a card than a letter which has no expiration date :)
