Thanks guys for making the effort to understand my situation.

i now need a couple of clarifications:

pune_guy, you are spot on in your interpretation that it would be a hard sell for an EB-2 application with the current employer.

So now, if I do change a job, I would have to use my EAD and hence I would have to join as an engineer(Because my understanding is, even though my current role is Business Development, my GC application is for an Engineer role and hence any new job based on EAD would have to be that of an Engineer).

Is that understanding correct?

Further, the new Eb-2 application from my would-be employer would be for an Engineer position.

Are my assumptions correct?

This query is for a friend of mine.

His labor and 140 was pre-approved.
In jun 2007 he applied for 485 / EAD and AP.
He got EAD, is working on it.
He also used AP to go to india and back.
His H1 is already expired this month.

All he has is a new AP based new i94 which expires on the day his EAD expires.

Now his drivers license is expiring.
Does anyone know the documents he will be required to submit to DL center to get DL extended.

Also the most important thing is, can the DL somehow be extended for more than 1 year. Because doing this every year is a pain.

DOS/USCIS had a co-ordination meeting to discuss how to prepare for the upcoming holiday's. The outcome of the meeting was to push EB2 cases as back as possible , so that people really can have a good time enjoying holiday. (When I say people read it as USCIS/FBI/DOS and lawyers ).

I work for Federal agency as contractor I know very well how things work during the holiday season.

You can use your h1b to work after returning to US on AP.


I believe that H1 is valid as long as you are with the same employer but once you switch employers thats a no deal.

EB3 quota is like a spoon of rice from a bag of basmati :))
It maked me laugh and a good one too. Any way now it is a feast, so everything is going to open.

Are you exempted from cap if you were on H1B in last 6 years or your received your H1 B in past 6 years?


I was on H1B from feb 2001 to Aug 2004 and then moved to F2 and then H4 Will I still be exempted from cap though my initial H1 has been more than 6 years old.

Hi,
I had sent an e-mail to my attorney...below is his reply...looks like i will get my renewed EAD before current EAD expires.


USCIS typically issues new EADs within 90 days. If they don't, you may make an Infopass appointment to appear in-person at a local office to request that they process an interim EAD. The local office will not issue an EAD. Rather, they will contact the Service Center which will typically issue the EAD within two weeks.

from what I have heard TB can be deadly. (btw I am not a doctor). I don't know what your post means but if it seems that you do have some form (or mild TB or whatever) ..then do take advantage of the treatments that are available ..health is wealth (esp go for treatment if you have insurance etc)

Sec 203 (b) (3)
but is there any text associated?

This is my understanding, when I look the 140 form...

You can either look into 'Part2 (Petition Type)' what is applied for when you file, OR you can look 'Classification' under "FOR CIS USE ONLY', where the CIS officer will approve what you checked in 'Petition Type'...

EB1--
203(b) (1) (A) Alien of Extraordinary ability
203 (b) (1) (B) Outstanding professor or researcher

EB2---
203(b) (2) Member of professions w/adv degree or exceptional ability

EB3--
203 (b) (3) (A) (i) Skilled worker
203 (b) (3) (A) (ii) Professional
